REGULATIONS governing provision of information services
(coming into force starting from January 1, 2008)

 

These REGULATIONS apply to stock exchange information services provided by WSE and described in "Price list for information services provided by Warsaw Stock Exchange", hereinafter referred to as "Price List", available on WSE's Website:
Price list 2011 - PDF.

Following items of the Price List are considered as continuous services:
1. A. Statistical data - daily subscription
2. B. WSE publications in electronic format - 14,15
3. C. WSE periodical data
4. D. Intraday


Items A, B, C, D of the Price List are considered as standard services.

I. PROVISION OF INFORMATION SERVICES

 

 

  1. Information services shall be provided after submitting by the Ordering Party of an order form to WSE and confirmation of the order by WSE. Order form is available at following address:


    II. CANCELLATION OR MODIFICATION OF ORDER FOR INFORMATION SERVICES

     

    1. Order may be cancelled or modified by the Ordering Party prior to its execution by WSE (mailing by electronic mail / HTTPS or on a CD by Post), with reservation of point 5.
    2. Ordering Party can retract or change its order sending to WSE cancellation or modification notice.
    3. Termination or change of agreement for provision of continuous services can be done at any moment, effective from beginning of quarter subsequent to quarter when WSE received a notice of termination or change.
    4. In case of agreement's termination according to point II sub-point 3 of these Regulations, collected fees are refunded in amount of 1/4 of an annual fee for each full quarter remaining until the end of year.
    5. In case of change in agreement Ordering Party shall pay an adequate extra charge from the beginning of quarter in which amended Order entered into force. If as a result of Order's change an overcharge appears, WSE will return the overcharge for each full calendar quarter revised order is in force.

    III. COMPLAINTS

     

    1. If information service is not performed in accordance with the order, then within 7 calendar days from execution of information service, or within 7 days from date a continuous service was commenced, Ordering Party must notify WSE sending a complaint.
    2. All complaints shall be considered within 3 days of their receipt. Failing to notify WSE within the deadline mentioned in point III sub-point 1 will result in loss of right for complaint.
    3. In case a complaint regarding information service is accepted, WSE shall perform the service once again, however if repeated performance of such service will not be possible WSE shall return the money paid by Ordering Party. In case of continuous services the refunded amount will be proportional to number of days claimed in such accepted complaint.

    IV. PAYMENTS

     

    1. For information services rendered WSE will charge fees as quoted in Price List. Whenever required by provisions of law VAT shall be added to prices quoted in Price List.
    2. Ordering Party is required to pay via bank transfer to account indicated on invoice within 30 days from the day of issuing of the invoice by WSE after acceptance of order.
    3. In case of any delayed payment WSE is entitled to charge statutory interest for every day of delay and to suspend provision of continuous services until payment is done. Suspension of continuous services becomes effective after a written notice serviced to Ordering Party by WSE with a request for payment within given deadline, not shorter than 14 calendar days however, remains void.

    V. LIMITATIONS

     

    1. Ordering Party receiving data from WSE, covered by Price List items, can distribute it (with exception of CeduĊ‚a) in form of electronic record exclusively within the enterprise named in the Order.
      Distribution of aforementioned data in form of an electronic record outside of an enterprise named in the Order is possible only in case when for a specified product ordered Price List determines a separate charge for obtaining WSE data with right for redistribution. This is, however, subject to prior notification of WSE about such desire and payment of an appropriate fee.
    2. Distribution and copying of data, encompassed by Price List, in form of an electronic record is forbidden without a prior written consent from WSE, with exception of cases described above.
    3. In case of breach of the Regulations by Ordering Party, in particular regarding sub-point 1 or 2 above WSE may suspend and terminate execution of continuous services. The termination should be preceded by notice from the Stock Exchange to perform these Regulations properly. Should the Ordering Party fail to improve the way it performs the Regulations, the Stock Exchange may terminate continuous services without returning the money paid by Ordering Party.
    4. WSE reserves the right to introduce changes in Price List at any time. These changes shall not apply to Orders already approved by WSE for execution before new Price entered into force.
    5. WSE reserves the right to introduce changes into these Regulations at any time, notifying Ordering Party about such change.
    6. WSE notifies all users of its information and advertising services about changes in Regulations and Price List via electronic mail and by an announcement on WSE's Internet Website.
    7. WSE spares no effort so that ordered information and advertising services provided by WSE are rendered with due diligence, and transmitted data is complete and current. Within the limits defined by provisions of law WSE shall bear no responsibility, whatsoever, for mistakes, delays and breaks in execution of orders and for any outcomes resulting from use of such data or decisions made on ground of such data by Ordering Party or any third parties.
    8. WSE's liability for information and advertising services provided is limited to the amount of fees paid by Ordering party for any ordered service.

    VI. TECHNICAL REQUIREMENTS

    In order to use information services provided by WSE hardware and software must meet following requirements:

    Hardware:
    PC computer with Pentium III 600MHz processor or better;
    128 MB of RAM memory or more;
    Graphic Card minimum SVGA working with resolution of 800x600px or better;
    Colour monitor working at 800x600px or higher resolution;
    Keyboard and mouse;
    CD-Rom reader x 48

    Parameters of Internet connection:
    Internet connection's bandwidth of at least 128 kbps;
    E-mail box allowing reception of mail with total volume 25MB with attached files of a unit volume of at least 2MB each (optionally if delivery via e-mail is chosen).

    Software:
    Operational system working in graphic mode at resolution of at least 800x600 (for instance Microsoft Windows 9x / 2000 / XP, Microsoft Office Excel in version 2000 or higher, Microsoft Office Word in version 2000, and Internet browser working in graphic mode for example: Microsoft Internet Explorer 6)
    Acrobat Reader in version 5.0 or higher
    Software allowing reading zip type archives (for instance Winzip)

    Information services provided by WSE have been adjusted to computers compatible with aforementioned specifications, however this does not mean that they cannot be used on computers other than PC or PC computers that do not meet minimum requirements.

    VII. PROTECTION OF PERSONAL DATA

    Personal data will be processed by WSE following all security measures, which have been laid down in the Law, dated 29th of August 1997, on Protection of Personal Data. Everyone has the possibility to look up his/her data and the right to correct them and WSE is obliged to stop processing of such data at Ordering party's request, which must be submitted to WSE in written form.

    VIII. NOTIFICATIONS

    All information, notifications, orders and complaints directed to WSE on ground of these Regulations should be serviced:
     

    1. to an e-mail address: historical.data@wse.com.pl
      or
       
    2. by fax to: (+4822) 537 71 34.

  2. Via electronic mail to an E-mail address indicated on the order form,
    or
     
  3. Via HTTPS,
  4. Via Post on a CD.
  • In case volume of ordered data exceed 25 MB then such data will be send via Post on a CD only.
  • In case data is send via post service, order execution dates described within these Regulations shall not include time needed for postal delivery.
  • WSE covers cost of parcels delivered via Post.
